Last Friday, former Senior President Trump advisor Peter Navarro was arrested for non-compliance to a summons to appear in court. Navarro had been subpoenaed by the January 6th committee but had no plans to appear. He explained why in an interview with Fox News host Tucker Carlson Monday evening. According to a Department of Justice policy in effect since the 1970s, Navarro stated, “…this Office has advised that the President and his immediate advisors are absolutely immune from testimonial compulsion by a Congressional committee on matters related to their official duties.”
According to the FBI, Navarro was indicted on contempt of Congress charges for defying Jan. 6 committee charges. Navarro is one of several witnesses suing the Jan. 6 committee in federal court. The claim is that the committee is violating enforcement functions, including breaking the terms of its enabling resolution.
Speaker of the House Nancy Pelosi (D-CA) took an unprecedented step by refusing to seat some Republican members. After House Minority Leader Kevin McCarthy (R-CA) withdrew all of his nominees in response, Pelosi personally picked the committee members, consisting of seven Democrats and two Republicans. This contradicts the eight Democrats and five Republicans that the resolution requires. The committee has no official ranking member, and some critics believe that the subpoenas are invalid.
While en route to a television interview in Tennessee last Friday morning, the FBI arrested Navarro at the Reagan airport, just one day after appearing on MSNBC. He promised he’d lead efforts to promote the impeachment of President Joe Biden if Republicans take Congress in the midterm elections in November.
