Trump Targets Rogue Brazilian Judge Behind U.S. Censorship Orders—Declares National Emergency, Hits with 50% Tariff

In a bold move to protect American sovereignty and constitutional rights, President Donald J. Trump has declared a new national emergency targeting the Government of Brazil. The decision comes in response to what the administration calls serious threats to U.S. national security, foreign policy, and economic interests. To confront those threats, Trump signed an Executive Order today imposing an additional 40% tariff—bringing the total tariff rate on Brazilian imports to 50%.

The action stems from what the administration describes as a growing pattern of political persecution, judicial tyranny, and free speech violations orchestrated by Brazilian Supreme Court Justice Alexandre de Moraes and his allies.

A Foreign Threat to U.S. Rights and Interests

Today’s Executive Order invokes emergency powers under the International Emergency Economic Powers Act (IEEPA), identifying Brazil’s internal political actions as a direct threat to American citizens, companies, and values.

According to the White House Fact Sheet, “since 2019, Brazilian Supreme Court Justice Alexandre de Moraes has abused his judicial authority to threaten, target, and intimidate thousands of his political opponents, shield corrupt allies, and suppress dissent, often in coordination with other Brazilian officials, including other justices on Brazil’s Supreme Federal Court, to the detriment of U.S. companies operating in Brazil.”

  • Justice de Moraes has unilaterally issued hundreds of orders to secretly censor his political critics. When U.S. companies have refused to comply with these orders, he imposed substantial fines, ordered the companies’ exclusion from Brazil’s social media market, threatened their executives with criminal prosecution, and, in one case, froze the assets of a U.S. company in Brazil in an effort to coerce compliance.
  • In fact, in addition to jailing individuals without trial for social media posts, Justice de Moraes is currently overseeing the Government of Brazil’s criminal prosecution of Paulo Figueiredo, a U.S. resident, for speech he made on U.S. soil, and has supported criminal investigations into other U.S. persons after they exposed his gross violations of human rights and corruption.

The Executive Order describes these acts as “serious human rights abuses” that not only destabilize the rule of law in Brazil but also threaten the rights of U.S. persons and the operations of U.S. companies abroad.

Tariffs as a Tool of Accountability

The Trump administration is using one of its most potent economic tools—tariffs—to hold foreign governments accountable. The new 50% tariff is aimed directly at Brazil’s government for allowing, and in some cases enabling, judicial overreach that violates free speech and international norms.

President Trump made clear that this is not only about economic pressure, but about defending constitutional principles on a global scale. “President Trump is defending American companies from extortion, protecting American persons from political persecution, safeguarding American free speech from censorship, and saving the American economy from being subject to the arbitrary edicts of a tyrannical foreign judge,” the fact sheet states.

America First, Again

This latest move is consistent with Trump’s broader “America First” foreign policy strategy, reaffirmed in his Day One directive to the State Department. That directive emphasized that U.S. foreign policy must always prioritize the interests, freedoms, and security of the American people.

Following up on that policy, Secretary of State Marco Rubio previously announced visa restrictions for foreign nationals responsible for censorship. On July 18, Trump directed those restrictions be applied to Justice de Moraes, his court allies, and their immediate families.

The White House emphasized that preserving free speech and defending U.S. businesses from political coercion will remain at the forefront of Trump’s second-term foreign policy agenda.
